{"id":33437,"date":"2019-05-10T14:27:39","date_gmt":"2019-05-10T14:27:39","guid":{"rendered":"https:\/\/enreach.es\/blog\/les-claus-del-registre-de-la-jornada-laboral-dels-empleats\/"},"modified":"2022-06-23T13:51:12","modified_gmt":"2022-06-23T13:51:12","slug":"les-claus-del-registre-de-la-jornada-laboral-dels-empleats","status":"publish","type":"post","link":"https:\/\/enreach.es\/ca\/blog\/les-claus-del-registre-de-la-jornada-laboral-dels-empleats\/","title":{"rendered":"Les claus del registre de la jornada laboral dels empleats"},"content":{"rendered":"<p>El 12 de maig entra en vigor l\u2019obligaci\u00f3 per a totes les empreses de registrar di\u00e0riament l\u2019inici i el final de la jornada laboral dels seus empleats, tant per a les grans com per a les petites companyies.<\/p>\n<p>El reial decret aprovat pel Govern no especifica la manera en qu\u00e8 ha d\u2019aplicar-se aquest control, que deixa en mans de la negociaci\u00f3 entre els empresaris i els representants dels treballadors (quan n\u2019hi hagi), per\u00f2 s\u00ed recull el mandat de <strong>registrar \u201cl\u2019horari concret\u201d del comen\u00e7ament i el final de la jornada dels treballadors<\/strong>.<\/p>\n<p>El registre obligatori de la jornada laboral \u00e9s un assumpte reclamat pels sindicats d\u2019inspectors de treball des de fa temps, ja que sense un control diari de l\u2019horari dels empleats, l\u2019autoritat laboral tenia grans problemes per provar els incompliments en mat\u00e8ria de jornada i descansos com, per exemple, l\u2019ab\u00fas de les hores extraordin\u00e0ries.<\/p>\n<h5><strong>Com ha de ser el registre?<\/strong><\/h5>\n<p>El control horari obligatori est\u00e0 regulat pel <a href=\"https:\/\/www.boe.es\/diario_boe\/txt.php?id=BOE-A-2019-3481\">reial decret del 8 mar\u00e7<\/a> de protecci\u00f3 social i de lluita contra la precarietat laboral en la jornada de treball. El text legal nom\u00e9s estableix que \u201cl\u2019empresa garantir\u00e0 el registre diari de jornada, que haur\u00e0 d\u2019incloure l\u2019horari concret d\u2019inici i finalitzaci\u00f3 de la jornada de treball de cada persona treballadora\u201d.<\/p>\n<p>Aquest registre pot ser <strong>\u201cmanual, amb una signatura dels treballadors en l\u2019hora d\u2019inici i sorida; o electr\u00f2nic, a trav\u00e9s d\u2019empremta dactilar, fitxant amb una targeta, amb una app m\u00f2bil\u201d<\/strong>.<\/p>\n<p>El reial decret concreta dos requisits m\u00e9s del control horari: <strong>les empreses han de conservar els registres durant quatre anys<\/strong> i aquests han d\u2019estar \u201ca disposici\u00f3 de les persones treballadores, dels seus representants legals i de la inspecci\u00f3 de Treball i Seguretat Social\u201d.<\/p>\n<h5><strong>Les dificultats: horaris flexibles i privacitat<\/strong><\/h5>\n<p>Existeixen dos reptes. D\u2019una banda, <strong>com registrar la jornada de les persones amb horaris molt flexibles<\/strong>, i la dels empleats que no sempre estiguin presents en el centre de treball, com els comercials, els teletreballadors, els treballadors destinats a l\u2019estranger, entre d\u2019altres.<\/p>\n<p>D\u2019altra banda, el segon repte est\u00e0 relacionat amb les conseq\u00fc\u00e8ncies de l\u2019aplicaci\u00f3 d\u2019alguns m\u00e8todes de registre electr\u00f2nic quant a la <strong>protecci\u00f3 de dades dels empleats i la garantia de la seva intimitat i privacitat<\/strong>.<\/p>\n<h5><strong>Conseq\u00fc\u00e8ncies per a les empreses que incompleixin la normativa<\/strong><\/h5>\n<p>Les organitzacions que incompleixin aquesta obligaci\u00f3 legal hauran de fer front a diverses sancions econ\u00f2miques. Aquestes dependran del tipus d\u2019incompliment:<\/p>\n<ul>\n<li><strong>Infraccions lleus<\/strong>: de 60 a 625 euros, segons es produeixin per no informar de les principals condicions laborals o per incomplir el proc\u00e9s pel que s\u2019ha d\u2019informar a les autoritats.<\/li>\n<li><strong>Infraccions greus<\/strong>: de 625 a 6.250 euros, en funci\u00f3 de les irregularitats detectades en els horaris pactats o la realitzaci\u00f3 d\u2019hores extra no computades ni pagades.<\/li>\n<li><strong>Infraccions molt greus:<\/strong> de 6.250 a 187.515 euros, si s\u2019ha produ\u00eft un augment considerable de les hores extra sense que aquestes quedin reflectides en un canvi de tipus de contracte, o b\u00e9 si s\u2019ha superat el m\u00e0xim legal de 80 hores extra anuals o aquestes no s\u2019han abonat adequadament.<\/li>\n<\/ul>\n<p>\u00c9s a dir, les sancions econ\u00f2miques pot produir-se tant per l\u2019abs\u00e8ncia de sistemes de control com per la manca de comunicaci\u00f3 de la realitzaci\u00f3 d\u2019hores extra, o per l\u2019encobriment de les hores extra sota altres conceptes salarials o tipologia contractual.<\/p>\n<h5><strong>Quines solucions poden ajudar-te a realitzar el control horari a la teva empresa?<\/strong><\/h5>\n<p>En el cas de <strong>masvoz<\/strong>, companyia especialitzada en serveis de comunicaci\u00f3 en el n\u00favol per a empreses, oferim dos tipus de solucions, en funci\u00f3 de les necessitats de cada organitzaci\u00f3:<\/p>\n<ol>\n<li><strong>Treball presencial:<\/strong> l\u2019empleat nom\u00e9s ha de marcar des de la seva pr\u00f2pia extensi\u00f3 el n\u00famero curt de l\u2019extensi\u00f3 de registre de jornada, i introduir el seu codi personal per a qu\u00e8 el sistema l\u2019identifiqui. Despr\u00e9s ha de seleccionar en el men\u00fa l\u2019opci\u00f3 d\u2019entrada o sortida, segons correspongui. Un cop la trucada estigui registrada, el propi sistema informar\u00e0 al treballador i tallar\u00e0 la trucada.<\/li>\n<li><strong>Treball a dist\u00e0ncia: <\/strong>l\u2019empleat ha de trucar a un n\u00famero 900, que se li haur\u00e0 facilitat, en qu\u00e8 s\u2019identificar\u00e0 mitjan\u00e7ant un codi personal assignat pr\u00e8viament per l\u2019empresa. Despr\u00e9s seleccionar\u00e0 en el men\u00fa l\u2019opci\u00f3 que correspongui (entrada o sortida).
